Baldwin’s trial is scheduled for July and will involve the same judge and prosecutors as well as many of the same witnesses. But Gutierrez-Reed's trial included previously undisclosed testimony from eyewitnesses to the shooting. “Alec Baldwin’s conduct and his lack of gun safety inside that church on that day is something that he’s going to have to answer for," prosecutor Kari Morrissey said in her closing arguments against Gutierrez-Reed. The filming of “Rust” moved to Montana after the shooting in New Mexico, under an agreement with Hutchins' widower, Matthew Hutchins, that made him an executive producer.

(AP) — A grand jury indicted Alec Baldwin on Friday on an involuntary manslaughter charge in a 2021 fatal shooting during a rehearsal on a movie set in New Mexico, reviving a dormant case against the A-list actor. Special prosecutors brought the case before a grand jury in Santa Fe this week, months after receiving a new analysis of the gun that was used. Baldwin, the lead actor and a co-producer on the Western movie “Rust,” was pointing a gun at cinematographer Halyna Hutchins during a rehearsal on a movie set outside Santa Fe in October 2021 when the gun went off, killing her and wounding director Joel Souza. CNN —The armorer on the set of the movie “Rust” likely was hungover when she loaded a prop gun used by actor Alec Baldwin that fired a live round of ammunition during a rehearsal, killing cinematographer Halyna Hutchins, prosecutors said in a court filing. Witnesses told investigators Hannah Gutierrez Reed “was drinking heavily and smoking marijuana in the evenings during the shooting of Rust,” prosecutors said in the Friday filing. Gutierrez Reed will plead not guilty to two counts of involuntary manslaughter in connection with the October 2021 shooting, an attorney for her has said. A final decision on charges against Baldwin would be made before August 8, prosecutors said in the Friday filing. Through their respective attorneys, both Gutierrez Reed and Halls accused Baldwin of deflecting blame onto others.

CNN has contacted the special prosecutor in the Santa Fe, New Mexico case for comment. Baldwin and “Rust” armorer Hannah Gutierrez Reed were both charged with involuntary manslaughter in January. An attorney for Gutierrez Reed has previously said she will plead not guilty. Prosecutors already removed a firearm enhancement charge against Baldwin and Gutierrez Reed, reducing a potential prison sentence from 5 years to a maximum of 18 months.

CNN —Filming of the movie “Rust” will resume this week. On Tuesday, a spokesperson for Rust Movie Productions told CNN that principal photography of “Rust” is set to resume Thursday at Yellowstone Film Ranch in Montana. Production on the western starring Alec Baldwin came to a halt in 2021, when cinematographer Halyna Hutchins was fatally shot when a prop gun Baldwin was holding fired a live round of ammunition during rehearsal. Baldwin and Souza will also return to finish the project, according to Rust Movie Productions. Baldwin and “Rust” armorer Hannah Gutierrez Reed were charged with involuntary manslaughter in Hutchins’ death in January.

Baldwin's lawyers had called the so-called firearm enhancement unconstitutional in a motion filed Feb. 10. Two days after Baldwin's defense filed the Feb. 10 motion, special prosecutor Andrea Reeb wrote in an email: "We are a tad confused on your motion on the firearm enhancement." A couple hours later, Reeb sent a third email, admitting that the prosecutors were wrong and that she "100 percent" agreed with Baldwin's lawyers' evaluation of the firearm enhancement. "I will have our documents drafted to amend the criminal information to take off the firearm enhancement," she wrote. Days later, the prosecutors officially downgraded the charges, removing the firearm enhancement that could have landed Baldwin more than five years in prison if convicted.

Hutchins was killed by a bullet from a gun Baldwin was holding in 2021. Matthew Hutchins, the widower of Halyna Hutchins, will join as an executive producer on the movie, along with the original producers. Bianca Cline, the cinematographer for the Oscar-nominated "Marcel the Shell with Shoes On," will take over as the "Rust" cinematographer. Matthew Hutchins will also serve as an executive producer of a new documentary on his late wife's life and work. Halyna Hutchins' mother, father, and sister filed a separate civil suit against Baldwin last week, which Matthew is not directly involved in.
